CHAPTER 16 CRIMINAL JUSTICE AUTOMATION COMMISSION

§ 16101. Definitions.
- (a) ’ Commission ’ means the Guam Criminal Justice Automation Commission.
- (b) ’ Criminal justice information ’ means all criminal justice information system data. The term includes: criminal history record information; biographic data; biometric data; identity history; person, organization, property, or Division of Motor Vehicles data; case or incident history; firearms, and other data necessary for authorized agencies to make hiring decisions, perform their mission, and enforce the laws of Guam. (c) ’ Criminal Justice Information System ’ or ’ CJIS ’ means the computer hardware, software, and communication network which is managed, operated, and maintained by the Commission for the collection, warehousing, and timely dissemination of criminal justice information to authorized agencies. 2025 NOTE: Reference to the ’ Territory ’ replaced with ‘Guam’ pursuant to 1 GCA § 420.
§ 16102. Establishment of Criminal Justice Automation Commission and Membership.
There is hereby established the Criminal Justice Automation Commission (Commission), which shall oversee Guam ’ s Criminal Justice Information System (CJIS).
- (a) Commission Leadership. The Commission shall be co-chaired by:
- the Chief Justice of Guam or his or her designee; and
- the Chief Technology Officer of the Executive Branch of the Government of Guam.
- (b) Commission Membership. The Commission shall consist of heads of the following agencies:
- the Bureau of Statistics and Plans;
- the Department of Agriculture;
- the Department of Corrections;
- the Guam Customs and Quarantine Agency;
- the Department of Parks and Recreation;
- the Department of Public Health and Social Services, Division of Children ’ s Wellness;
- the Department of Revenue and Taxation;
- the Department of Youth Affairs;
- the Guam Behavioral Health and Wellness Center;

(10) the Guam Homeland Security - Office of Civil Defense; (11) the Antonio B. Won Pat International Airport Authority, Guam; (12) the Guam Police Department; (13) the Mariana Regional Fusion Center; (14) the Office of the Attorney General;
- the Port Authority of Guam; and (16) I Liheslaturan Guåhan ’ s Committee on Public Safety or a legislative committee with similar oversight. (c) An agency head under (b) may designate a person from within his or her agency to serve in his or her place. Where an agency head designates a representative, and the agency maintains a law enforcement division or unit, the designee shall be from that division or unit. (d) The Commission shall meet at least once during each calendar quarter and at such other times as the chairpersons deem necessary. (e) No member of the Commission shall receive any compensation for the performance of duties associated with membership on this Commission. 2025 NOTE: Reference to the ‘Guam Legislature’ replaced with I Liheslaturan Guåhan pursuant to 2 GCA § 1101. § 16103. Commission Duties and Responsibilities.
The Commission shall have the authority to: (a) Manage, operate, and maintain the collection, warehousing, and timely dissemination of criminal justice information to departments, agencies, and instrumentalities of the Government of Guam as authorized by the Commission. (b) Develop and maintain a process to determine if and how changes to existing criminal justice applications impact the CJIS. Changes to criminal justice applications, databases, platforms or business processes that have an impact on the integrated network must be coordinated through and approved by the Commission. (c) Develop appropriate policies to address privacy and civil liberty concerns related to the sharing of data, data management, and retention. (d) Recommend any legislation necessary for the implementation, operation and maintenance of the CJIS. (e) Develop and adopt rules and procedures to govern its conduct and operations, and to provide for data integrity, consistency, and interoperability amongst all information technology platforms. The rules and procedures shall include, but are not limited to, policies which support seamless data sharing, regular implementation of technology updates, and robust cybersecurity measures. (f) Perform all functions necessary to carry out the duties of this Chapter. (g) Submit a written report no later than May 1st of each year to I Maga’hågan/Maga’låhen Guåhan and the Speaker of I Liheslaturan Guåhan summarizing the Commission ’ s activities, accomplishments, challenges, and plans to enhance interagency collaboration and improve the integration of Guam ’ s criminal justice information systems. The report shall also include information

regarding associated costs and interagency agreements related to criminal justice data-sharing infrastructure.
